Terms & Conditions

These terms govern access to and use of Aviral Medcare, the EMR and hospital management platform built by Ebslon Infotech.

1. About the platform

Using the website, requesting a demonstration, opening an account or working in the software means you accept these terms.

Aviral Medcare supports the administrative, clinical, operational, financial and management workflows of eye hospitals and ophthalmology clinics.

It is a technology platform. It does not diagnose, treat, or give medical advice on its own account.

2. Authorised use

Only authorised individuals and organisations may use the platform. Those users must:

  • Give accurate information where it is asked for.
  • Keep account credentials confidential.
  • Use the platform for legitimate business and healthcare purposes only.
  • Follow their own organisation's internal policies.
  • Not attempt to get around security or access restrictions.
  • Not reach into records belonging to other users, patients, branches or organisations without proper authorisation.

3. Clinical responsibility

The platform records, organises and presents healthcare information. It does not practise medicine.

Clinicians and healthcare organisations remain responsible for clinical decisions, diagnosis, prescriptions, treatment plans, what is communicated to a patient, and patient safety.

Nothing in the software substitutes for professional medical judgement, and it should never be relied on as though it did.

4. Customer responsibility

The organisation using Aviral Medcare is responsible for:

  • Maintaining appropriate user access.
  • Protecting login credentials.
  • Entering accurate information.
  • Checking information before relying on it.
  • Keeping sensible internal security procedures.
  • Ensuring its use of the platform complies with the laws and regulations that apply to it.

5. Accounts and access

Where accounts are issued, the customer must make sure they are used only by the people they were issued to.

We may suspend or restrict access where that is reasonably necessary to protect the platform, its users, their data, or the security of the service.

6. Intellectual property

The software, its interface, design, branding, documentation, features and underlying technology remain the property of Ebslon Infotech or its licensors.

These terms grant use of the platform. They transfer no ownership of it.

Information and content that a customer lawfully puts into the platform remains theirs, subject to the applicable agreement and legal requirements.

7. Third-party integrations

The platform can connect to outside services, communication providers, devices and other systems.

Whether such an integration works, and keeps working, depends on the third party running it. We are not answerable for changes, interruptions or failures on their side that sit outside our reasonable control.

8. Availability

We work to keep the service reliable. Uninterrupted availability is not something any honest vendor guarantees.

Availability can be affected by maintenance, infrastructure faults, connectivity, third-party dependencies, security incidents, and events beyond our reasonable control.

9. What users must not do

  • Attempt to gain unauthorised access.
  • Reverse engineer or exploit the platform.
  • Introduce malicious software.
  • Interfere with how the system operates.
  • Circumvent security controls.
  • Use the service for unlawful purposes.
  • Access or disclose confidential information without authorisation.

10. Changes to the service

Features will be added, improved, altered and occasionally retired as the product develops.

Where a material change affects an existing customer, the notice and transition arrangements are the ones set out in that customer's commercial or service agreement.

11. Limitation of liability

Aviral Medcare is supplied as a software platform supporting healthcare and administrative workflows.

So far as the law allows, Ebslon Infotech is not responsible for losses arising from unauthorised use, incorrect information entered by users, clinical decisions, third-party service failures, connectivity problems, or circumstances outside our reasonable control.

Nothing here is meant to exclude liability that cannot lawfully be excluded.

12. Termination

Access may be terminated or suspended in line with the applicable customer agreement, or where a material breach of these terms, a security concern, unlawful use or another legitimate reason makes it necessary.

What happens to customer data afterwards is governed by that agreement and by the law.

13. Changes to these terms

These terms may be updated from time to time. The current version is always the one published here.
